ECI Deploys Central Observers for Bihar and J&K Bye-Elections

The Election Commission of India (ECI) announced the deployment of Central Observers on Sunday for the forthcoming Bihar Assembly elections and bye-elections in eight assembly segments across the nation. These include the Budgam and Nagrota constituencies in Jammu and Kashmir. This strategic move aims to enhance the transparency and efficiency of the electoral process.

The deployment of observers follows the guidelines set forth in Article 324 of the Constitution and Section 20B of the Representation of the People Act, 1951. The ECI’s mandate enables these observers to ensure the orderly conduct of elections in each region.

Following significant anticipation, the announcement marks a crucial moment for the long-pending bye-elections in Jammu and Kashmir’s 90-member Legislative Assembly. The commission’s timely intervention underscores its commitment to a democratic process.

  • The Nagrota seat became vacant after the unexpected passing of BJP legislator and senior leader Devender Singh Rana on October 31, 2024. He died shortly after the Assembly election results were declared on October 8, 2024. There are speculations around his daughter, Devyani Rana, as a potential candidate for the BJP, though official confirmation is still awaited.
  • Conversely, the Budgam seat was vacated by Chief Minister Omar Abdullah on October 21, 2024. Abdullah successfully contested from both Budgam and his family stronghold, Ganderbal. In a strategic move, he decided to retain Ganderbal, leaving Budgam open for competition. The National Conference appears to hold a competitive edge in Budgam, though the candidate selection process remains in progress.

The ECI’s deployment of 470 officers includes 320 from the IAS, 60 from the IPS, and 90 from IRS/IRAS/ICAS services for effective monitoring of the electoral events not only in Bihar but also in the eight other states and Union Territories scheduled for bye-elections.

The primary role of these observers is to act as the eyes and ears of the Commission, ensuring that the election remains fair and credible. Their responsibilities include:

  • Monitoring poll conduct to ensure compliance with ECI guidelines.
  • Overseeing the law and order situation, campaign integrity, and electoral management.
  • Tracking candidates’ election expenditures to prevent any malpractices.
  • Encouraging voter awareness and increasing participation in the electoral process.

“The observers are entrusted with the crucial responsibility of upholding the impartiality and credibility of elections – the bedrock of democratic polity,” an ECI statement highlighted.

The broader electoral context indicates that the ECI plans to announce the Bihar Assembly election schedule by mid-October. Additionally, the Commission has set October 24, 2025, as the date for biennial elections to fill four vacant Rajya Sabha seats from Jammu and Kashmir. This proactive scheduling enhances the overall voter engagement across regions.
